DAILY ORDER

Mr. H.K. Das, learned counsel for the applicant submitted that the applicant was working as Sub-Postmaster, Changsari S.O. with the authorisation to keep up to Rs. 20,000/- as cash. On 13.07.2016, when he had excess cash, he approached the concerned authority for collection of the same. According to the applicant, he again approached the concerned authorities on 14.07.2016 for collection of the cash beyond the limit. However, no collection was made in those dates. The collection was, however, made on 15.07.2016 along with the collections from other posts offices, namely, Baihata Chariali, Bezera and Kulhati SO. The cash got looted by miscreants during transit.

The applicant's case is that out of the various Sub Post Offices whose cash was looted in transit, only the applicant has been proceeded under rule 16 of C.C.S. (C.C.A.) Rules, 1965 and the recovery of Rs. 3,00,000/- (Rs. Three lakh) has been ordered. This, according to the learned counsel, is discriminatory.

In view of the above submissions, issue notice. Mrs. Kakali Saikia, learned Addl. CGSC is present in the court and accepts notice on behalf of all the respondents.

Fix the matter on 08.09.2017 before the Joint Registrar's court for completion of pleadings. During the pendency of the O.A., the recovery will remain stayed. The respondents will, however, have liberty to seek modification, alteration etc. of the above orders.
