Heard. Learned counsel contends, inter-alia, that the applicant was eligible for promotion when the teachers of other subjects were considered and promoted but his claim for promotion from due date has been rejected vide impugned order wherein the respondents nowhere pleaded non-availability of vacancy in the relevant subject. He argued that once the applicant was eligible, vacancy was available in his subject and juniors were promoted in their respective subjects, then the action of the respondents in not considering his case for promotion from the relevant date is illegal and arbitrary. Issue notice to the respondents. List on 29.04.2020.
