M.A. No. 060/2060/2021 has been filed by the original applicants in order to place on record their replication to written statement filed by Respondents No. 1, 2 and 3.

Prayer made in the said miscellaneous application is allowed for the reasons stated therein.

Accordingly, the original applicants' replication to written statement of Respondents No. 1, 2 and 3 is ordered to be taken on record.

Original Application

Sh. Onkar Rai, learned counsel for the applicant submitted that during pendency of the original application, while issuing an order dated 08.03.2021, the respondents have stated that the seniority of the members of service in the cadre of Fitter, who were appointed between 24.12.2002 to 04.08.2015, has been determined in terms of an office letter No. 590/OFBL/A/I, dated 24.12.2002.

Learned counsel further submitted that the applicants No. 1 & 2 were appointed as Machinist on 09.07.2002 and 16.07.2002 respectively and in their case, the respondents cannot be permitted to adopt the different yardsticks to determine their seniority.

Confronted with this, Sh. Sanjay Goyal, learned Sr. CGSC has prayed for an adjournment enabling him to seek instructions from the respondents and to clarify the situation by way of filing an additional affidavit.

Accordingly, the matter is adjourned to 12.10.2021.
