When this matter was taken up today, we noted that R-3 has not complied with our order dated 05.01.2018.

Learned counsel appearing for the Lakshadweep Administration filed a memo with Dy. No. 1164 along with a calculation statement pertaining to the applicants  in the different O.As pending before this Tribunal regarding the amounts to be recovered from them under New Pension Scheme.

Shri Unnikrishnan, learned counsel for the applicant pointed out that the issue relating to pensioners has been remaining unresolved for a long time causing distress to the applicants due to various other issues relating to amounts to be settled under NPS  and that not even provisional pension  is sanctioned to many of the applicants. 

Learned counsel for the Lakshadweep Administration submitted that the calculation sheet filed along with the memo today indicates the contribution of the Government as well as that of the new total corpus built up along with interest, the amount already paid to the individual and also the amount the individual is required to refund.

Shri Unnikrishnan submitted that the decision relating to the final settlement is within the authority of the respondent No. 3, who has to take a final arrangement so far as off setting the dues against the total entitlements to each pensioner.

In the circumstances, we feel that the personal appearance of the present incumbent of respondent No. 3 is necessary to appraise this Tribunal for a proper resolution of the imbroglio.  We, therefore, direct respondent No. 3 to appear in person.  The Pay and Accounts Officer of Lakshadweep Administration shall also be present on 06.04.2018.

Issue a copy of this order to the learned counsel appearing on both sides.

Registry is also directed to communicate this order by Fax message to respondent No.3 and to the Pay and Accounts Officer, Lakshadweep Administration.

Respondents are directed to complete the pleadings (as finally) by the next posting date.
