Heard the learned counsel for the parties on the interim relief sought by the applicant. Learned counsel for the applicant submitted that although the applicant has retired on 13.4.2016 he has not been paid any pension, gratuity except the leave encashment of Rs. 2,22,133/-. On 3.4.2017 when this matter was taken up, it was submitted by the learned counsel appearing for Lakshadweep Administration that respondent No. 5 will be passing necessary orders on that date regarding sanction of pension and pensionary benefits to the applicant. When the case was taken up today it was submitted by the learned counsel for the respondents Lakshadweep Administration that as per the instructions receivedby him pension papers in respect of the applicant were already submitted to the pension wing for sanction and authorization of pension on 3.4.2017 itself and that it is expected that sanction and issue authorization of pension will be done within a week or two. The counsel for respondents submitted that on such sanction and authorization the same has to be sent to respondent No. 3 the Controller General of Accounts/Central Pension Accounting Office, Ministry of Finance, Department of Expenditure, New Delhi who is the authority to issue the special seal authority and to communicate the same to the applicant's bank. In the above circumstance this Tribunal directs respondents Nos. 2, 4 & 7 to complete the pension papers and authorization in all respects positively within two weeks from today and the same shall be forwarded to respondent No. 3 on the same date when such process is completed. Respondent No. 3 is directed to ensure that special seal authority is issued to the applicant's bank within two weeks after receipt of the said authorization. List the matter on the reopening day after summer holidays on 16.5.2017. Issue a copy of this order today itself to learned ACGSC to communicate the same to respondent No. 3 for compliance without fail. Issue a copy of this order to learned Standing Counsel for the Lakshadweep Administration.
