Learned counsel for the applicant submitted that applicant's father Late Dimbeswar Hira while working as Trackman in Lumding Division expired on 15.09.2005. On compassionate ground, the younger son of the deceased, namely Ratul Hira was appointed as Gateman, SS/LFG. However, tragically Ratul Hira also died in harness on 19.01.2015, against that applicant has applied for compassionate appointment. However, the same has been rejected vide letter no.E/CGA/RH-241/01-15/142 dated 02.12.2016 on the ground that dependency of the applicant on the deceased employee is not proved. According to the learned counsel, applicant has submitted the documents demanded by the respondents. Therefore, there is prima facie case for the court to intervene in the matter. In view of the above, issue notice to the respondents. Mr.M.K.Majumdar, learned railway standing counsel accepted notices on behalf of all the respondents. List the matter on 22.06.2017 before the Joint Registrar for completion of pleadings. Pendency of this OA shall not be a bar for the respondents to take a favourable decision in favour of the applicant.
