Counsel on both side present. Learned counsel for the applicant submitted copies of the judgment of this Tribunal in OA.810/14, and OA. 666/14. He also submitted that this case is squarely covered by the order of Ernakulam Bench and on this ground alone the applicant is entitled to get family pension as well as death gratuity and sought time for production of the same. Ms. N. Shakti representing Sr. CGSC, however, placed before this Tribunal a copy of the instructions received to the effect that the NPS amount Rs.3,17,532-78/- was credited into the bank account of applicant on 05.08.2015. She also produced necessary documentary evidence to this effect. Counsel for the respondents is directed to produce the original records relating to the applicant and also clarify as to whether the applicant has exercised an option for the new pension scheme. List the matter on 14.03.2017 under the caption ‘Part heard’. In the meanwhile, counsel for the applicant is also permitted to produce copy of the judgment of the coordinate Bench at Ernakulam. |
