Learned counsel, inter-alia, contended that the Competent Authority has committed a legal error in handing over the charge of Acting Principal to Rajesh Kumar Sharma (respondent no.6) against the directions contained in the order dated 05.03.2009 in OA No.109-CH of 2009 of this Tribunal (Annexure A-6). The argument, is that, even the respondent no.6 did not fulfill the requisite qualifications and was ineligible as per Recruitment Rules to perform the duty of Acting Principal, whereas the applicant is only eligible person to perform such duties. Heard. Issue notice to the respondents returnable within a period of four weeks. At this stage, Mr. Gagandeep Singh Chhina, Advocate on behalf of respondents no.1 to 3 & 5 and Mr. B.B. Sharma, Advocate on behalf of respondent no.4, appear and accept notice on their behalf. Notice be issued for securing the presence of private respondent no.6 for the next date of hearing. Let the file be placed before the learned Registrar on 24.11.2017, for service of private respondent no.6 and for completion of pleadings by the parties.
