Heard the learned counsel for the applicant.

2.  The applicant is working as a time scale Farm Worker in the respondents' organization.  He has put in more than 35 years of service.  The applicant submits that the Central Industrial Tribunal-cum-Labour Court in C.R. No.151/2017 awarded raising the age of retirement of time scale Farm Workers to 60 years.  The applicant prays that he also needs to be granted the benefit of the said award, by allowing him to retire at the age of 60 years.  However, the applicant informs that the respondents have not issued any impugned order, but they are going to retire him on 5.02.2020.  Therefore, he prays for an interim direction to the respondents to allow him in service till the O.A. is adjudicated upon.  

3.   Learned counsel for the applicant submits that not raising the retirement age of time scale Farm Workers to 60 years, is against the Award granted by the Central Industrial Tribunal in C.R. No.151/2017.  Further, the co-ordinate Bench of C.A.T. at Bangalore in O.A. No.461/2019 and this Bench of the Tribunal in O.A. No.681/2019 in a similar issue have also granted interim relief to the applicants therein.

4.    In view of the above, the applicant being similarly situated to that of the applicants in the above said O.As, the respondents are directed not to take any coercive action against the applicant till they file their reply. 

5.   Respondents are granted four weeks time to file reply.  List the matter on 05.03.2020.
