This case was taken up today as per the Board published today.   It was so published on a mentioning having been made by Shri.CSG Nair the day before yesterday.  Learned counsel for the applicant submitted that in view of an memorandum issued by the Headquarters, ESI Corporation, New Delhi on 23.1.2018 the transfer of the applicant to Gulbarga, Karnataka has been superseded.  Hence he prays for recording that aspect and closing the matter. 

Learned counsel for the ESI Corporation, Shri.Sandesh Raja, objected to this, stating that the aforesaid O.M is a subject matter of series of other O.As filed by the officials mentioned in the aforesaid memorandum being aggrieved by transferring them to Gulbarga.

In the circumstance we feel that this O.A has to be taken up on the original date of its posting ie. 23.2.2018 on which date the cases challenging the aforesaid memorandum are also posted.
