Considering the grounds stated in the MA No.212/2020, the same is allowed and delay is condoned.         

        In the instant OA, the grievance of the applicant of the deceased railway employee with regard to non grant of benefit of MACP was raised by the Railway Union and in response to it, vide communication dated 27.1.2017, the Divisional office of Western Railway, Ahmedabad informed to the Secretary of the recognized Union of Western Railway at Ahmedabad that during the service period, Shri Mohammed Qureshi, deceased railway employee got three promotion for his entire service and thereafter he took voluntary retirement on 31.7.2016. Therefore, he is not eligible for the benefits of MACP. Aggrieved by it, the applicant has filed the present OA.  Counsel for the applicant submits that inadvertently the applicant has not prayed for quashing of the said decision of the respondents though it was referred to him in his OA (Annexure A/3).  Therefore, he has filed the present MA for amendment, more particularly, in prayer clause of the MA No.328/2021. Considering the grounds stated in the MA No.328/2021, the same is allowed. The applicant is directed to carry out necessary amendment within a week.  It is noticed that the respondents have filed their reply in the main OA and denied the claim of eligibility of the applicant for grant of benefits of the MACP. List the matter for final hearing on 06.09.2021.
