Through Video Conferencing The present M.A. has been filed by the applicant to declare the results of Tier-I Examination and allow him to appear for Tier-II, Tier-III and Tier-IV Examination, if he qualifies in Tier-I Examination, by issuing an Admit Card. 2. The brief facts of the case are that the applicant has filed OA20/150/2020 wherein the respondents were directed to permit the applicant to appear in the Combined (Graduate Level) Examination 2019 in different Tiers, subject to his qualifying in each Tier, as stituplated in the notification, by issuing Hall Ticket to the applicant. However, the selection of the applicant, in case he clears all the Tiers, shall not be declared and would be subject to finalization of the O.A. 3. The respondents, as per the directions of the Tribunal, issued the Admit Card, and the applicant appeared in the examination on 06.03.2020. The applicant claims that he has scored well in the examination. The respondents have declared the results on 01.07.2020. The result of the applicant has been withheld by the respondents, stating that the case is pending in the Tribunal. The applicant claims that the respondents have not abided by the Tribunal’s referred to above. Therefore, he prayed that the respondents be directed to declare the result of Tier-I Examination and if he were to pass in the examination, he may be allowed to appear in the rest of the Tiers, depending upon his clearance in the respective Tiers, as was ordered by the Tribunal in its order dated 21.02.2020. 4. Heard Smt. A. Chayadevi, learned counsel for the applicant and Smt. K. Rajitha, learned counsel for the respondents. 5. It is clear that the Tribunal vide is order dated 21.02.2020, directed the respondents to permit the applicant to appear in different tiers of the examination, and as he qualifies in each tier, he may be permitted to appear in the next tier. It is surprising that despite such an order, the respondents have not declared the result of the applicant in Tier-I of the examination, which is incorrect. 6. In view of the above, the respondents are directed to declare the result of the applicant in Tier-I of the examination and, if he were to pass in Tier-I, he may be allowed to appear in Tier-II and in the subsequent Tiers also, in case he passes in the respective Tiers of the examination. The final selection of the applicant is subject to the disposal of the O.A. 7. With the above directions, the MA is allowed. The respondents shall take action as directed, within one week from the date of receipt of this order. 8. Admit. List the matter before Registrar’s Court for completion of pleadings.
