Heard the learned counsel on both sides.

2.   Learned counsel for the applicant submits that there is a delay of 108 days in re-presentation of the restoration petition after complying with the objections raised by the Registry and prays that the delay may be condoned.  I take a lenient view in this matter as it deals with the beneficiary scheme of compassionate appointment and I feel that the person seeking compassionate appointment should not suffer because of the omission and commission of his counsel.  Accordingly, MA No.171/2017 is allowed.  

3.  Learned counsel for the applicant stated that when the OA came up for hearing on 24.8.2016, she was suffering from viral fever and asked her colleague to represent the case but she was also held up in her office work and could not attend the Court in time and as such the OA was dismissed for default.  She prays for restoration of the OA.  In the circumstances and in the interest of justice, MA No.172/2016 is allowed.  Accordingly, the OA is restored to file.  

4.  List the OA for final hearing on 16.3.2017.
