While disposing of the Original Application No.60/891/2020 on 20.11.2020, a direction was issued to the respondents to consider and decide the applicant's representation Annexure A-6 by way of passing a reasoned and speaking order.  A further direction was also issued that while deciding the said representation, the respondents shall take into consideration the law laid down by the Hon'ble Supreme Court in the case of M. Nagraj and Ors. Vs. UOI & Others (2006 (8) SCC 212) and other subsequent judgments on the issue.  The respondents were granted four weeks' time to carry out the directions issued by this Tribunal.  Since the respondents failed to comply with the order passed by this Tribunal within the stipulated period of four weeks, therefore, the applicant filed the present miscellaneous application for execution of the said order.

At the very outset, Sh. R.K. Sharma, learned counsel for the applicant has stated that during pendency of the execution application, the respondents have issued an order dated 29.06.2021 vide which the applicant has been promoted to the post of Senior Nursing Officer.

In view of the above, the execution stands satisfied and the Miscellaneous Application No.60/1076/2021 is disposed of accordingly.
