Heard Ms.Anita Swain representing Mr.A.V.Gopal Rao, learned counsel for the petitioner and Mr.B.Venkanna, representing Mr.A.Radha Krishna, counsel for the alleged contemnor.

Being aggrieved by the order of this Tribunal dated 29.12.2016, Union of India approached the Hon'ble High Court by filing Writ Petition Nos.19725 & 19789 of 2017.  The Hon'ble High Court dismissed the said Writ Petitions vide order dated 22.02.2018 upholding the order of this Tribunal.  It is noticed that the order of this Tribunal had attained finality, in view of the dismissal of the Writ Petitions by the Hon'ble High Court.

In this Contempt Petition notice was issued to the alleged contemnors vide order dated 18.09.2017.  Thereafter the matter was listed on several occasions.  On 25.10.2018 this Tribunal has passed the order, which reads as follows :

"Learned counsel for the respondents has submitted a letter dated 18.10.2018 intimating that the relief will be provided within four weeks time and the order of this Tribunal will be implemented.  Time is granted.  In case the order of this Tribunal is not implemented within the said period, respondents will have to appear in person and appraise this Tribunal the reasons for the delay."

Again the matter was listed on 10.01.2019, where this Tribunal ordered fresh notice in Form-I to the alleged contemnors 1 to 2 to appear before this Tribunal on 07.02.2019.  Matter was again listed on 07.02.2019.  On that day learned counsel for the alleged contemnors filed proceedings dated 05.02.2019 stating that the proposal for waiving of recovery has been referred to the Ministry of Finance in pursuance of DoPT OM dated 02.03.2016.  Matter was adjourned to 07.03.2019.  Thereafter, matter was listed on several occasions, however, the alleged contemnors neither complied with the order of this Tribunal nor appeared before this Tribunal. 

 Today learned counsel appearing for the alleged contemnors is not in a position to explain as to why the matter has not been implemented.  This Contempt Petition is pending for a long time and neither the order of this Tribunal has been complied with nor compliance report has been filed.  This amounts to be a contemptuous act of the alleged contemnors which shows disrespect and disregard of the Tribunal's order dated 29.12.2016.  Thus, against the majesty of the Court.  Hence this Tribunal has expressed displeasure against the alleged contemnors.

However, in the interest of justice, finally the alleged contemnors are given two months time to file their compliance report, failing which the alleged contemnors shall appear in person before this Court on the next date of hearing at 10.30 A.M.

However, we impose cost of Rs.5000/- each against the alleged contemnors which shall be paid by them from their own pocket and the amount will be deposited to C.A.T. Bar Association within a period of one month from the date of receipt of the order for legal assistance to the poor litigants.

Post the matter on 19.12.2019.
