As the charge sheet being already filed, despite objections of the prosecution, this Court is of the opinion to state the circumstances do not warrant to leave the jewelries stated in the said PF, with I.O. As the PF No.36/2023 specifies that a gold chain weighing around 07.980 grams worth Rs.39,000/- is left with I.O, as the objections of the prosecution do not make out any circumstance to leave the said jewellary with the I.O only, as the posession over the same with the first informant , in the light of first information and the charge sheet materials, appearing to be proper with him, this Court opines that the above application merits consideration. Hence it is allowed. I.O shall release the same (gold chain 07.980 grams worth Rs.39,000/-) to the interim custody of the applicant aforesaid after obtaining the report of renowned goldsmith regarding the quality and the nature of the said chain forthwith. Applicant shall not change its nature, model etc in whatsoever circumstances till further orders of the Court. Applicant shall execute his indemnity bond of Rs.50,000/- and shall furnish a surety for the likesum. If insisted, applicant shall produce the same to the Court without fail.
