Ex.P.6 to Ex.P8 i.e., IMV report, PM report, Inquest report are marked with consent of counsel for accused. Learned APP given up CW2 to CW6, CW11, CW12 and CW14 and prays for issuance of summons to other witnesses. Since, CW1 who is the material witnesses/informant to the case and CW7 who is eye witness and CW8 and 9 mahazar witnesses have completely turned hostile to the prosecution case, no purpose will be served in examining other witnesses, as the fate of the prosecution will not be changed but the same would nothing but abuse of process of Court. Hence, by rejecting the prayer of Learned APP CW10, CW13, CW15 and CW16 are hereby dropped from their examination. Since, there are no incriminating evidence arose from the evidence of prosecution witnesses, their statement U/Sec. 313 of Cr.P.C is hereby dispensed with. Matter is heard for expeditious disposal.
