The learned counsel for respondent filed objections to delay condonation application/IA No.1, stay application/IA No.2 and objections to appeal memo. On perusal of record, it is found that IA No.1 is filed seeking condonation of delay of 20 days and the ground urged is that though the order was passed on 12.06.2023, he could not come to no passing the order and came to know about the order only on 04.07.2023. of course, there is no reason assigned as to, what was the reason for not knowing order on the day it was passed and thus as rightly objected by the other side, there is no legal reason supporting the application. However, since admittedly, the order impugned is passed under Section 23 of the DV Act awarding interim maintenance and it appeared that to put an end to the lis, by giving fair opportunity of hearing, the delay needs to be condoned, IA No.1 is allowed on cost of Rs.1,000/-. The learned counsel for appellant prayed time to pay the cost. Since, IA No.2 is filed seeking stay of the impugned order which is as noted above is nothing but an interim maintenance order which can be heard and disposed off without calling TCR, both the parties are directed to to address arguments on merits itself.
