The learned APP has submitted that this case is no longer required to be tried against the accused. Perused the case record which reveals that the Charge Sheet in this case is submitted by I/O u/s 341/294/323 IPC against the accused Rajesh Dey and the case is in appearance stage and offence is not explained to accused till now. As the government wants to withdraw the case and APP has filed a petition u/s 321 Cr.P.C., the petition is allowed. The case is accordingly disposed of on withdrawal by learned APP.
